SUMMARY:Phased Re-Planning and Legal Challenges in a COVID-19 World
DESCRIPTION:Register Now \n  \nWith phased reopening underway\, planning and zoning departments across the country are trying to accommodate new methods of operation in a COVID-19 world\, as well as how those changes will carry over once we are out of the pandemic. Many planners are now armed with new tools authorized by executive order. But are these planning tools enough? Are there legal barriers that could impede their success? This program will focus on legal and planning issues which are likely to arise as businesses reopen and the pandemic concludes. Topics to be discussed will include legal issues with executive orders\, virtual hearings (and whatever hybrid form they may soon take)\, relaxation of zoning regulations and local codes\, expedited permitting processes\, and actions that can be taken now to be better prepared for the next pandemic. The program will also address equity considerations related to these issues. Each panelist will offer a different perspective on this topic as a law professor\, mayor\, and land use attorneys representing private developers and municipalities. The discussion and best practices shared are intended to assist planners in other disaster situations.

In just two months\, total employment in the state has fallen to the same level as 1985\, thirty-five years ago. In addition to deep short-term recession woes\, the shocks of the coronavirus are accelerating the pace of structural change and raising profound questions and uncertainties about the future. \nFor example\, the “office” is central to the economy of New Jersey. Will the magnitude of distress in office markets caused by the pandemic match the distress of bricks and mortar retailing caused by the rise of e-commerce? While the post-pandemic office has yet to be invented\, there will certainly be a rebalancing of office ecologies\, with significant planning implications. \nBuilding dense\, walkable\, transit-dependent\, mixed-use\, LWP (live\, work\, play) environments was a planning and development mantra of the past decade. Low-density\, automobile-centric suburbs were viewed as fading obsolete relics of the twentieth century\, while the “cool quotient” of urban areas soared. Can these pre-pandemic structures endure and adapt to post-pandemic health strictures? Will there be a pandemic-induced “resprawling” of New Jersey? \nThese are just some of the questions that the planning profession must confront. Join James W. Hughes and Joseph J. DESCRIPTION:Register\nIn 2015\, with the Pope and tons of visitors heading to town\, Philadelphia became the largest city in North America to legalize short-term residential rentals (such as ones listed on AirBnB\, HomeAway.com\, and through other booking agents). With changes to the city’s zoning and tax code\, a system was put into place that addressed the interests of property owners renting spare rooms and entire units\, the guests they hosted\, neighbors and traditional hotel operators. An interdisciplinary group worked together to ensure local legislation matched the reality of activity already occurring and the needs of the community. This session will cover the challenges faced and policy options considered\, plus a comparison to other cities and counties across the United States.

According to a 2014 study\, 54% of US manufacturers over $1billion in revenue are considering Reshoring some or all of their manufacturing. Site evaluation and the correct site selection are critical to the success of these projects. Establishing manufacturing at the right site has an economic multiplier effect on communities. Manufacturing jobs pay well and workers use their wages to buy homes\, cars and other goods in the local community. Everybody wins. Reshoring is a very popular idea among businesses\, their customers and governments where jobs growth will have the most impact. But it’s not that simple. Reshoring requires a carefully crafted journey through innovation\, automation\, localization of products and site/community selection. You will learn about the major components in this decision and what you need to develop a business case to bring manufacturing back to specific communities. We will also learn about some reshoring failures\, where selecting the wrong site had devastating results.

SUMMARY:Webcast: Housing for People with Disabilities: A Civil Rights Lens
DESCRIPTION:Register \nThis presentation will discuss significant changes in housing for people with disabilities over the last several years. Enforcement of the Americans with Disabilities Act and the Supreme Court’s decision in Olmstead v. L.C. – which requires public entities to offer their services to people with disabilities in “the integrated setting” – has led to statewide system reform of housing systems\, moving away from congregate disability-specific housing to expanding access to scattered-site supportive housing. Ms. Barkoff will discuss the requirements of the ADA and Olmstead and describe the housing provisions in recent Olmstead settlement agreements. The changing landscape of disability housing has also been impacted by changes in the disability service system\, including new requirements for settings in which publicly-funded community-based services can be provided. Ms. Barkoff will explain how these changes in the service system may lead to change in housing systems. Finally\, Mr. Frost will describe implementation of an Olmstead settlement agreement in his home state of New Hampshire. \nCM 1.5

SUMMARY:Webcast: Recent Changes to the National Flood Insurance Program: What can a planner do?
DESCRIPTION:Register Now\nSeventy years ago\, efforts to control floodwater in the United States focused on structural projects such as dams\, levees\, and seawalls. This approach did not reduce flood losses and development continued in flood hazard areas. A broader strategy developed over time to include both the management of floodwater and damage-prone development. Established by the U.S. Congress in 1968\, the National Flood Insurance Program (NFIP) provides a general framework to mitigate future flood losses that communities must adopt and enforce as a condition for federally backed flood insurance protection. Mounting flood losses and recent catastrophic events\, however\, have bankrupted the NFIP. This financial instability led to the adoption of the Biggert-Waters Flood Insurance Reform Act in 2012 (BW-12) to extend the NFIP for five years and make significant changes in insurance and mapping requirements. The insurance requirements were designed to make the NFIP self-supporting\, but had significant unintended consequences. The Homeowner Flood Insurance Affordability Act of 2014 now repeals and modifies certain provisions of BW-12. This presentation will review some of these changes and outline steps that planners can take to mitigate present and future impacts of the new law. Planners are best trained to synthesize the multi-disciplinary nature of hazard mitigation planning and can be at the forefront of achieving reductions in losses to life and property as well as creating safer communities. \nCM 1.5

SUMMARY:Webcast: Drought Planning Toolbox: State Strategies for Mitigation and Adaptation
DESCRIPTION:Register Now\nDrought is becoming an increasingly important issue for planners at the local\, regional and state levels. Drought impacts vary by region\, but it affects everything from the most obvious — water supply — to ecosystems\, the built environment\, regional economies and human health. Mitigation and adaptation to drought requires attention and collaboration among planners\, water engineers and natural resource experts. In 1998\, more than one-third of the U.S. was affected by drought. The event began on the West Coast\, spanned the Rocky Mountain region and\, eventually\, the upper Midwest. In 2007-2008\, a drought impacted Georgia\, resulting in inter-state conflicts over water rights. Today\, California is in the midst of a truly historic drought event. Tools and techniques\, such as those outlined in the APA Planning Advisory Service report\, “Planning and Drought\,” are emerging to bring together the various disciplines involved in water management and land use. The Drought Planning Toolbox webinar will feature speakers from California\, Colorado and the Susquehanna River Commission who will share their experiences and best practices from their regions in preparing for and responding to drought. Highlighted strategies will focus on mitigation\, adaptation and drought planning; participants will learn about drought plans adopted by states and regions and key elements of drought mitigation and adaptation. Participants also will learn about how collaboration and intergovernmental coordination is essential for drought adaptation and resilience efforts.
