NJDEP Proposal to Renew Municipal Stormwater Permits

In early 2016, NJDEP requested comment on preliminary drafts of the renewed NJPDES Municipal Tier A and Tier B Stormwater General Permits, including their substantially revised “Post Construction Stormwater Management” requirements.

Among those submitting comments were the New Jersey Society of Municipal Engineers; a group of nine environmental organizations including the Association of New Jersey Environmental Commissions and the Natural Resources Defense Council; and several municipalities including the City of Newark, Lawrence Township (Mercer County) and Burlington Township, and Ringwood Borough.  Some comments expressed serious concerns about “Post Construction Stormwater Management” requirements.  At the April 12, 2016 public hearing, NJDEP announced its intent to issue the formal “Draft Permits” (and begin the “Formal Public Comment Period”) on August 1, 2016 (as of September 16, 2016, however, NJDEP has not yet issued these “Draft Permits”), and to issue the “Final Permits” in December 2016.  For more information, including the full text of already submitted comments and a compilation of comments on “Post Construction Stormwater Management” requirements, see the “NJAPA Stormwater Article” folder at this link: https://1drv.ms/f/s!AqWLnhXjVjSJyRGKeG5SkMDxdCU2 .
